Government Gazette No. 44320 of 25 March 2021, adopt, as requested by the National Research Foundation, the amended Chapter 2 and Chapter 5 of the Integrated Environmental Management Plan for the Square Kilometre Array (Phase 1) and notify that two additional conditions have been added to paragraph 4 of Government Notice No. 436 published in Government Gazette No. 42323 on 22 March 2019, and furthermore notify that condition 4.1.1.2 of that Notice has been amended as set out in the Schedule hereto.
The Integrated Environmental Management Plan was adopted as an environmental management instrument for the purposes of excluding the National Research Foundation, in terms of section 24(2)(e) of the National Environmental Management Act, 1998 (Act No. 107 of 1998), from the requirement to obtain environmental authorisation for activities identified in terms of section 24(2)(a) and (b) of the National Environmental Management Act, 1998 (Act No. 107 of 1998) which are associated with the development of Phase 1 of the Square Kilometre Array, and which were described in Chapter 2 of the Integrated Environmental Management Plan, under specific conditions, as set out in Government Notice No. 436 published in Government Gazette No. 42323 on 22 March 2019.
Background
This Schedule applies to the amendment of Chapter 2 and Chapter 5 of the Integrated Environmental Management Plan (IEMP) for the Square Kilometre Array (SKA) (Phase 1) as well as the amendment to the conditions of exclusion as contained in Government Notice No. 436 published in Government Gazette No. 42323 on 22 March 2019 (Exclusion Notice of 2019). The IEMP was adopted as an environmental management instrument and based on the adopted IEMP, the National Research Foundation was excluded, in terms of section 24(2)(e) of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (the Act), from the requirement to obtain environmental authorisation for activities associated with SKA (Phase 1) as contemplated in Chapter 2: Part IV of the adopted IEMP. This adoption and exclusion was contained in the Exclusion Notice of 2019.
